Flight downgrade compensation in the EU.
Can you claim it? What is the amount you may claim? What are the rules?
Imagine buying a ticket for a first class, but upon reaching the airport you are informed that you will be flying in business or economy class instead? What if you purchased a business class ticket, only to be told later that your seat is now in economy class? There are very precise rules for this. And, indeed, you can claim compensation from Virgin Atlantic. This is applicable to all Virgin Atlantic flights to, within and from Europe.
Airline downgrade compensation has to be offered right on the spot.
1. Virgin Atlantic Flight Downgrade Compensation
In the EU, the rights of air passengers are strictly regulated.
- If your Virgin Atlantic flight is delayed, you can get flight delay compensation.
- If it’s cancelled – flight cancellation compensation.
- If you are denied boarding – denied boarding compensation.
If you are downgraded, you may claim for flight downgrade compensation. The amounts of involuntary airline downgrade compensation range from 30 to 75% of the ticket price, depending on the distance of your flight. This does not impact your Virgin Atlantic baggage allowance. After all, it is not your mistake that led to downgrade. It’s the airline’s fault.
This is applicable to all Virgin Atlantic flights to and from Europe.
For airlines outside the EU, this is only applicable to flights departing from Europe.

2. How to Claim Virgin Atlantic Downgrade Compensation?
Flight downgrade compensation should be paid on spot.
Therefore, under normal circumstances, you shouldn’t be required to take any action.
However, if this doesn’t happen, be sure to reach out to Virgin Atlantic and file a claim. Otherwise, if you don’t take any action, Virgin Atlantic is likely to do the same. Nothing. Keep in mind that this compensation should be transferred to your bank account. You are not obligated to accept any Virgin Atlantic vouchers.
In case of any complications, refer to Regulation (EC) No 261/2004.
3. How Much Can You Claim for a Flight Downgrade?
The amounts of flight downgrade compensation are regulated by the EU.
This is how you can calculate your Virgin Atlantic compensation:
- 30%, if the distance of your flight is up to 1500 kilometres,
- 50%, if the distance of your flight is between 1500 – 3500 kilometres,
- 75%, if the distance of your flight is more than 3500 kilometres.
These percentages are of the price you paid for your flight.
4. What About Free Upgrades?
Suppose there are no more vacant seats in the economy class, and you’re offered a seat in the business class. That’s acceptable, but you should note, that the airline may not ask for any additional payment for this upgrade.
It’s just an involuntary Virgin Atlantic upgrade.
EU and Non-EU Airlines
What happens if you’re flying with a non-European airline?
A non-European airline like Qatar Airways or Turkish Airlines, not Virgin Atlantic?
In these situations European regulations only apply to flights departing from Europe.
If you’re flying with a European airline, these regulations apply to all commercial flights to and from Europe (as well as within Europe). In the case of non-EU airlines, such as Turkish Airlines or Qatar Airways, these rules are applicable only to their flights departing from Europe, not the reverse. For all other scenarios, you’ll need to adhere to the local laws of the departure country and the airline’s specific downgrade policies.
First Class vs. Business Class
The travel experience in First Class and Business Class on airlines differs significantly, both in terms of cost and the range of services offered. However, the service quality in both of these classes substantially surpasses that of Economy class.
First Class
First Class typically embodies the pinnacle of comfort and luxury an airline can provide.
The perks commonly encompass a seat that reclines fully, gourmet meals, a broad spectrum of beverages, and individualized service. You also get the privilege of access to exclusive airport lounges and priority boarding. Some airlines even extend the luxury by offering private suites for first-class passengers, putting a premium on privacy and lavishness.
Business Class
Though Business Class is a noticeable upgrade from Economy, it doesn’t quite reach the opulence of First Class. The seats are more spacious and comfortable than those in Economy class, but they may not always transform into a fully flat bed. The food is gourmet quality, and there’s a wide selection of beverages. Business Class passengers are also entitled to lounge access at the airport and priority boarding. However, the degree of privacy and personalized attention may not equal that offered in First Class.
